Transparency Program

Based on Article 7 of Law No. 119/2014 “On the Right to Information” (hereinafter “LDI”), the Public Authority (hereinafter “PA”) must publish the Transparency Program (hereinafter “PT”) approved by the Commissioner for the Right to Information and Personal Data Protection (hereinafter “the Commissioner”). The PA must publish information according to its functional activity, as well as review and update the PT in any case of change in institutional activity, legal regulatory framework or any other element related to proactive transparency.

The PT specifies the categories of information that must be made public. Public information without a request must be: complete, accurate, up-to-date, easy to consult, understandable, easily accessible and compatible with the original documents in the possession of the PA. Also, before publishing the information, the PA must assess whether there are any legal restrictions on publication.

Acts containing rules, norms or restrictions on the fundamental rights and freedoms of the individual, as well as those with direct effect for them, are made public by displaying or posting on the official website, within 48 hours of the adoption of the act by the PA. The transparency program specifies the categories of information that must be made public, the manner of publication, as well as the legal provisions from which the obligation to publish arises. When publishing information, PAs must take into account the public interest and enable easy access to public information.

The Agency for the Administration of Sequestered and Confiscated Assets is a public, budgetary legal entity, headquartered in Tirana, subordinate to the minister responsible for public order and security, and is the institution responsible for the administration and/or use of assets seized by decision issued by the justice system bodies or administrative bodies, the administration and/or use of confiscated assets, as well as the preservation of material evidence or their administration, according to the provisions of the legislation in force.

b.Request/Explanatory Forms (Steps to follow to make a request for information)

i. The request for information is made in writing and sent by hand, by mail or by e-mail, correctly presenting the identity of the requester and his signature.

ii. The request for information must contain: a) the name and surname of the applicant;

b) the postal or electronic address where the information is requested to be sent;

c) description of the information required;

ç) the format in which the information is prefered;

d) any data that the applicant considers may assist in identifying the requested information.

If you are dissatisfied with the way your request for information has been handled, you have a legal right to file a complaint. If you have made a written request and have not received a response or are dissatisfied with the response received from the Authority, you have the right to file an administrative complaint within 30 days. You can file a complaint with the Office of the Commissioner for the Right to Information and Personal Data Protection.

The complaint form must be completed in all respects. In cases where the requested information contains personal data, the applicant's identification document is required. The complaint form must be accompanied by the information request form addressed to the Public Authority, as well as the postal receipt or email addressed to the Public Authority.

The Agency for the Administration of Sequestered and Confiscated Assets is institutionally subordinate to the Ministry of Interior, which is the competent body to provide opinions regarding the process of drafting legal/sub-legal acts, public policies or in relation to the exercise of the functions of the AAPSK.
